to summon the Chief Secretary and Home Secretary of Jammu
and Kashmir for their failure to comply with the direction
of NHRC with regard to the inhumane torture and custodial
death of Mr Mohan Lal, son of Pheru Ram of Amritsar, Punjab
by the Jammu Police on 2 July 2003 (Case No 55/9/2003-2004)
Dear Mr Chowdhary,
I am writing pursuant to the directions
of the National Human Rights Commission of 25 July 2003,
25 August 2003 and 11 September 2003 to the Chief Secretary
and Home Secretary of Jammu and Kashmir pertaining to the
inhumane torture and custodial death of Mr Mohan Lal, son
of Pheru Ram of Mahal village, Amritsar, Punjab on 2 July
2003 at District Police Lines (DPL) hospital at Jammu, Jammu
and Kashmir on 2 July 2003.
The Chief Secretary
and Home Secretary of Jammu and Kashmir have repeatedly
failed to comply with the directions of the NHRC. Asian
Centre for Human Rights believes that this is a clear contempt
of the NHRC and a fit case for summoning the Chief Secretary
and Home Secretary under Section 13 of the Human Rights
Protection Act, 1993 to personally appear before the Commission
for the failure to comply with the directions.
Unless, NHRC
takes such measures, it is unlikely that the State government
authorities will respond to the directions of the NHRC.
