On 12 October 2011, Asian Centre for Human Rights filed a complaint with the NHRC with respect to the custodial death of Lallu Nayka (42 years) at Pardi police station in Valasad district of Gujarat on 22 September 2011. He was reportedly a witness in an unsolved murder case. On the night of 21 September 2011, the police took the deceased along with them to different places while carrying out investigation into the murder case.
The police claimed that the body of Lallu Nayka was found hanging by the sweeper of the police station in the cabin of Sub-Inspector B K Vanar at the Pardi police station where he had preferred to stay fearing an attack from the accused.
The NHRC registered the complaint (1010/6/26/2011-ad) and directed its Investigation Wing to collect the information.
By its proceedings dated 01.12.2016, the Commission had recommended to the Government of Gujarat to pay a sum of Rs. 1.00 lakh to the next of kin of the deceased Lallubhai Ravjibhai Nayak. Chief Secretary, Government of Gujarat was required to submit compliance report along with proof of payment within eight weeks.
Pursuant to the directions of the Commission, Under Secretary, Govt. of Gujarat, Home Department vide communication dated 03.04.2017 has sent a copy of proof of payment of monetary relief of Rs. one lakh to the next of kin of the deceased Lallubhai Ravjibhai Nayak.
The NHRC vide its order dated 16 January 2018 closed the complaint in view of compliance of recommendation of the NHRC.
